AN ORDINANCE
ESTABLISHING THE COUNTY SUPERVISOR DISTRICTS AND ELECTION PRECINCTS
BE IT ENACTED by the Board of Supervisors
of Tama County, Iowa:
Section
1. Purpose: The purpose of this ordinance is to establish election precincts
and County Supervisor districts as the result of the population changes
reflected by the 2000 federal decennial census, in accordance with Iowa Code
Sections 331.210A and 49.7.
Section
2. Boundaries of Election Precincts: Tama County shall have sixteen (16) election precincts whose
boundaries shall be as follows:
Precinct
#1, BUCKINGHAM/ PERRY/ EAST CRYSTAL: Beginning at the northwest corner of
Buckingham Township, at the corner of M Avenue and the Black Hawk County line
(in line with 100th Street), thence East six miles to S Avenue, at
the northeast corner of Buckingham Township, thence South on S Avenue (or in
line with S Avenue) Twelve (12) miles to 220th Street at the
southeast corner of Perry Township, thence West Seven and One-half (7.5) miles
on 220th Street (or in line with 220th Street) to the
centerline of K Avenue (in Crystal Township), thence North Six (6) miles on K
Avenue to 160th Street, thence East One and One-half (1.5) miles to M Avenue at
the northwest corner of Perry Township, thence North Six (6) miles to point of
beginning. (Including the city of
Traer.) [Precinct #1 is also described
as all of Buckingham Township; all of Perry Township; and that part of Crystal
Township east of the centerline of K Avenue; and the City of Traer.]

#2, CARLTON: Beginning at the northwest
corner of Carlton Township at the corner of Abbott Avenue and 220th
Street, thence East Six (6) miles to G Avenue at the northeast corner of
Carlton Township, thence South to 280th Street (in line with 280th
Street) at the southeast corner of Carlton Township, thence West to Abbott
Avenue at the southwest corner of Carlton Township, thence North to the point
of beginning, (Including the City of Garwin).
[Precinct #2 is also described as all of Carlton Township; and the City
of Garwin.]

#3, CARROLL/ ONEIDA: Beginning at the
northwest corner of Carroll Township at the corner of M Avenue and 220th
Street, thence East Twelve (12) miles to the corner of Iowa Highway 21 and 220th
Street at the northeast corner of Oneida Township, thence South Six (6) miles
on the centerline of Highway 21 to 280th Street at the southeast
corner of Oneida Township, thence West Twelve miles on 280th Street
(or in line with 280th Street) to M Avenue at the southwest corner
of Carroll Township, thence North Six (6) miles to the point of beginning. (Including the City of Clutier.) [Precinct #3 is also described as all of
Carroll Township; all of Oneida Township; and the City of Clutier.]

#4, CLARK/ GENESEO: Beginning at the
northwest corner of Geneseo Township at the corner of S Avenue and the Black
Hawk County line (in line with 100th Street), thence East Six (6)
miles to County Highway V-37 on the Tama-Benton county line, thence South Three
(3) miles on Highway V-37 and continuing South Nine (9) miles on Iowa Highway
21 to 220th Street at the southeast corner of Clark Township, thence
West Six (6) miles to S Avenue, thence North Twelve (12) miles on S Avenue (or
in line with S Avenue) to the point of beginning. (Including the City of
Dysart) [Precinct #4 is also described as all of Geneseo Township; all of Clark
Township; and the City of Dysart.]

#5, COLUMBIA: Beginning at the
northwest corner of Columbia Township at the corner of G Avenue and 340th
Street, thence East Six (6) miles in line with 340th Street to the
northeast corner of Columbia Township (in line with M Avenue), thence South Six
(6) miles to the corner of M Avenue and 400th Street, thence West
Six (6) miles on 400th Street to G Avenue, thence North Six (6)
miles to the point of beginning.
[Precinct #5 is also described as all of Columbia Township.]

#6, WEST CRYSTAL/ SPRING CREEK:
Beginning at the northwest corner of Spring Creek Township at the corner
of Abbott Avenue and 160th Street, thence East Ten and One-half
(10.5) miles in line with 340th Street to the centerline of K Avenue
in Crystal Township, thence South Six (6) miles to the corner of K Avenue and
220th Street, thence West Ten and One-half (10.5) miles on 220th
Street to Abbott Avenue at the southwest corner of Spring Creek Township,
thence North Six (6) miles to the point of beginning. (Including the City of Gladbrook.) [Precinct #5 is also described as all of Spring Creek Township;
that portion of Crystal Township west of K Avenue; and the City of Gladbrook.]

#7, GRANT: Beginning at the northwest
corner of Grant Township at the corner of G Avenue and 100th Street,
thence East Six (6) miles in line with 100th Street to the northeast
corner of Grant Township to M Avenue, thence South Six (6) miles to the corner
of M Avenue and 160th Street (in line with 160th Street)
at the southeast corner of Grant Township, thence West Six (6) miles on 160th
Street to G Avenue, thence North Six (6) miles on G Avenue to the point of
beginning. [Precinct #7 is also
described as all of Grant Township.]

#8, HIGHLAND/ INDIAN VILLAGE: Beginning
at the northwest corner of Indian Village Township at the corner of Abbott
Avenue and in line with 280th Street, thence East Six (6) miles to
the corner of G Avenue, thence South Five (5) miles on G Avenue (or in line
with G Avenue) to County Road E-49 (in line with 330th Street),
thence East One (1) mile on E-49 into Tama Township to a point in line with H
Avenue (at the northeast corner of Section 31 of Tama Township), thence South
on H Avenue One (1) mile to 340th Street (the southeast corner of
said Section 31), thence West on 340th Street One (1) mile to G
Avenue (the southwest corner of said Section 31), thence South Six (6) miles on
G Avenue to the southeast corner of Highland Township, in line with 400th
Street, thence West Six (6) miles to Abbott Avenue at the southwest corner of
Highland Township, thence North Twelve (12) miles to the point of beginning.
(Including the City of Montour.) [Precinct #8 is also described as all of the
City of Montour; all of Highland Township; all of Indian Village Township,
except that portion contained on the Indian Settlement trust land for the Sac
& Fax Tribe of the Mississippi in Iowa; and that part in Section 31of Tama
Township, excluding that portion contained on the Indian Settlement trust land
for the Sac & Fax Tribe of the Mississippi in Iowa.]
Precinct
#9, INDIAN SETTLEMENT: Notwithstanding any other provision in the Code of Iowa,
Indian settlement land held in trust by the secretary of the interior of the
United States for the Sac and Fox Tribe of the Mississippi in Iowa and its
trust land contiguous to the Indian settlement lying in Tama, Toledo and Indian
Village townships of Tama county shall be an election precinct. The Indian settlement precinct shall be
redrawn to include land contiguous to the Indian settlement when such land is
purchased by the settlement and added to the Indian settlement land held in
trust by the secretary of the interior of the United States. Upon recording of the deed transferring the
land to the United States in trust, the county recorder shall notify the county
commissioner of that fact. If the
commissioner is notified more than seventy days before the next scheduled
election, the commissioner shall redraw the precinct for that election. The commissioner shall notify the board of
supervisors of the redrawn precinct boundaries and shall certify the redrawn
boundaries to the state commissioner.
Land completely surrounded by the boundaries of the Indian settlement
precinct, but not included in the settlement precinct, shall be included in the
precinct in which such land was located prior to redrawing of the Indian
settlement precinct. The commissioner
shall notify registered voters in each of the redrawn precincts of the change
in the precincts and the proper polling place for those affected voters.

#10, OTTER CREEK/ TAMA/ TOLEDO: Beginning at the northwest corner of Otter
Creek Township at the corner of M Avenue and 280th Street, thence
East Six (6) miles to the corner of S Avenue, thence South on S Avenue (or in
line with S Avenue) Six (6) miles to 340th Street (or in line with
340th Street), thence West Eleven (11) miles to H Avenue (at the
southeast corner of Section 31in Tama Township, in line with H Avenue), thence
North One (1) mile in line with H Avenue to County Road E-49 at the
intersecting line with 330th Street (at the northeast corner of said
Section 31), thence West One (1) mile on County Road E-49 to G Avenue, thence
North One (1) mile on G Avenue to a point in line with 320th Street
at the southwest corner of Toledo Township (the southwest corner of Section
19), thence East Four and One-fourth (4.25)
miles in a line with 320th Street to the east Corporate limits of
the City of Toledo, thence North on the east Corporate limits of the City of
Toledo to 300th Street, thence East One-fourth (0.25) mile to K
Avenue, thence North One-fourth (0.25) mile to where 300th Street
continues East One and One-fourth (1.25) miles to M Avenue (or in line with M
Avenue), thence North in line with M Avenue Two (2) miles to the point of
beginning. (Including the City of Tama.)
[Precinct #10 is also described as all of Otter Creek Township; all of
the City of Tama; that portion of Toledo Township in Sections 13, 14, 23, and
24, except the north half of the Northwest Quarter of Section 14; and including
a portion of Tama Township, except Section 31, and except that portion of Tama
Township contained on the Indian Settlement trust land for the Sac & Fax
Tribe of the Mississippi in Iowa.]

#11, LINCOLN: Beginning at the
northwest corner of Lincoln Township at the corner of Abbott Avenue (in line
with Abbott Avenue) and 100th Street, thence East Six (6) miles in
line with 100th Street to the northeast corner of Lincoln Township
to G Avenue, thence South Six (6) miles to the corner of G Avenue and 160th
Street, thence West Six (6) miles on 160th Street to Abbott Avenue
(or in line with Abbott Avenue), thence North Six (6) miles to the point of
beginning. (Including the City of Lincoln.)
[Precinct #11 is also described as all of Lincoln Township; and the City
of Lincoln.]

#12, RICHLAND/ SALT CREEK: Beginning at
the northwest corner of Richland Township at the corner of M Avenue and 340th
Street, thence East Twelve (12) miles to the corner of Iowa Highway 21 and 340th
Street at the northeast corner of Salt Creek Township, thence South Six (6)
miles on the centerline of Highway 21 (or its extension) to the Poweshiek
County line to westerly extension of 400th Street at the southeast
corner of Salt Creek Township, thence West Twelve (12) miles on 400th
Street (or along the township line) to S Avenue, thence North Six (6) miles to
the point of beginning. (Including the
City of Chelsea.) [Precinct #12 is also
described as all of Richland Township; all of Salt Creek Township; and the City
of Chelsea.]

#13, TOLEDO 1/ HOWARD: Beginning at the
northwest corner of Howard Township at the corner of G Avenue and 220th
Street, thence East Six (6) miles to the corner of M Avenue, thence South on M
Avenue (or in line with M Avenue) Eight (8) miles, and into Toledo Township, to
300th Street, thence West One and One-half (1.5) miles to K Avenue,
thence South One-fourth (0.25) mile to where 300th Street continues
west to the east Corporate limits of the City of Toledo, thence West One-fourth
(0.25) mile on 300th Street to the east Corporate limits of the City
of Toledo, thence South One and Three-fourths (1.75) miles on K Avenue to the
south Corporate limits of the City of Toledo (in line with 320th
Street), thence West to a point in line with G Avenue , thence North in line
with G Avenue (approximately 10.5 miles) to 220th Street at the
northwest corner of Howard Township, the point of beginning, except that
portion contained on the Indian Settlement trust land for the Sac & Fax
Tribe of the Mississippi in Iowa. (Precinct including Ward 1 in the City of
Toledo.) [Precinct #13 is also described as all of Howard Township, and Ward 1
in the City of Toledo; and that portion of Toledo Township, with the exception
of Sections 13, 14, 23, and 24, described as part of Precinct 10; and except
that portion of Toledo Township contained on the Indian Settlement trust land
for the Sac & Fax Tribe of the Mississippi in Iowa.]

(or along the township line when 280th Street does not follow the
township line), thence East Six (6) miles in line with 280th Street
to the northeast corner of York Township at Iowa Highway 21, thence South Six
(6) miles to the corner of Highway 21 and 340th Street (or in line
with 340th Street), thence West Six (6) miles on 340th
Street (or in line with 340th Street) to S Avenue, thence North Six
(6) miles to the point of beginning.
[Precinct #16 is also described as all of York Township; and the Cities
of Elberon and Vining.]
Section
3. Boundaries of Supervisor Districts: The boundaries of the three supervisor districts shall be as
follows:
Supervisor
District #1 is made up of election precincts #1, 3, 4, 7, and 16.
Supervisor
District #2 is made up of election precincts #2, 6, 11, 13, 14, and 15.
Supervisor
District #3 is made up of election precincts #5, 8, 9, 10, and 12.
Section
4. Effective Date: This ordinance shall be effective
on January 15, 2002, after its final passage, approval, and publication as
provided by law.
